Terms of Service

1. Acceptance of Terms

By accessing or using XerisLaunch ("the Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and the operator of the Service.

2. Service Description

XerisLaunch is a website builder that generates token landing pages for cryptocurrency projects. The Service provides tools to create, customise, and optionally deploy single-page websites. XerisLaunch does not create, issue, manage, endorse, or provide advice about any cryptocurrency tokens.

3. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into binding agreements. By using the Service, you represent that you meet these requirements and that your use complies with all applicable laws in your jurisdiction.

4. User Responsibilities

You are solely responsible for all content you create, publish, or deploy through the Service. You agree not to use the Service to create content that is fraudulent or misleading to investors or the public; constitutes a scam, Ponzi scheme, or phishing attempt; solicits private keys, seed phrases, or wallet credentials; promotes illegal activities or violates applicable laws including securities regulations; contains hate speech, threats, or harassment; or infringes on intellectual property rights of third parties.

5. Content Moderation and Takedown

We employ automated content moderation to detect prohibited content before deployment. We reserve the right to review, flag, and remove any content deployed through the Service that violates these Terms. Sites may be taken down without prior notice if they pose immediate risk of harm. Repeated violations will result in permanent blocking. We cooperate with law enforcement and regulatory authorities when required by applicable law.

6. No Financial or Investment Advice

The Service is a website creation tool only. Nothing on XerisLaunch or any website created through it constitutes financial, investment, tax, or legal advice. We make no representations about the value, safety, or legitimacy of any cryptocurrency token featured on sites built with the Service. Users of deployed sites should conduct their own independent research before making any investment decisions.

7. Payment, Pricing, and EU Consumer Rights

Pro features are available for a one-time payment of €4.99 (or local currency equivalent). All prices displayed include applicable taxes. Payments are processed by Stripe, Inc. By completing a purchase, you acknowledge that you have read and agree to these Terms and our Privacy Policy.

EU Right of Withdrawal (14-Day Cooling-Off Period): Under the EU Consumer Rights Directive (2011/83/EU) and Irish regulations (S.I. No. 484/2013), you have the right to withdraw from your purchase within 14 days without giving any reason. However, by proceeding with your purchase and immediately accessing digital content (Pro features), you expressly consent to the performance of the contract beginning immediately and acknowledge that you lose your right of withdrawal once the digital content has been fully delivered. If you have not used any Pro features, you may request a full refund within 14 days by contacting us.

Outside the cooling-off period, refunds may be issued at our discretion within 30 days of purchase. Refunds will not be issued for accounts blocked or sites taken down due to Terms violations.

8. Deployed Sites

Sites deployed through the Service are hosted on third-party infrastructure (Vercel). We do not guarantee uptime, availability, or permanence of deployed sites. We may remove deployed sites at any time for Terms violations, abuse reports, legal requirements, or operational reasons. You are responsible for maintaining backups of your content.

9. Intellectual Property

You retain ownership of the original content you create. You grant us a limited, non-exclusive licence to host and display your content as necessary to provide the Service. The XerisLaunch name, logo, platform code, and templates remain our property or are licensed to us.

10. Limitation of Liability

To the maximum extent permitted by Irish and EU law, our total liability for any claim arising from your use of the Service shall not exceed the amount you paid (€4.99). We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Irish law.

11. Indemnification

You agree to indemnify and hold harmless the operator of XerisLaunch from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, your deployed websites, or your violation of these Terms or any applicable law.

12. Cryptocurrency Disclaimer

Cryptocurrency and token projects carry inherent risks including total loss of value. XerisLaunch is not responsible for any financial losses resulting from tokens promoted on sites created through the Service. The existence of a token website deployed through XerisLaunch does not constitute endorsement, verification, audit, or approval of any token project. See our full Disclaimer for details.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Ireland. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Ireland. If you are an EU consumer, you additionally benefit from any mandatory provisions of the law of your country of residence. Nothing in these Terms affects your statutory rights as a consumer under EU law.

14. EU Online Dispute Resolution

The European Commission provides an online dispute resolution (ODR) platform at https://ec.europa.eu/consumers/odr. We are not obligated to participate in alternative dispute resolution proceedings, but you may use this platform to submit a complaint.

15. Changes to Terms

We may update these Terms at any time. Material changes will be communicated by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance. If required by EU law, we will seek explicit consent for material changes affecting your rights.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable under Irish or EU law, the remaining provisions shall remain in full force and effect.
